Distance Sales Contract

By placing an order, the BUYER accepts in advance the obligation to pay the price of the subject matter of this contract and any additional fees such as shipping or taxes, if applicable.

Invoices will be issued by ROYAL PHARMA İLAÇ KOZMETİK GIDA VE SANAYİ A.Ş.

2. Definitions

MINISTER: Minister of Customs and Trade

MINISTRY: Ministry of Customs and Trade

LAW: Law No. 6502 on the Protection of Consumers

REGULATION: Regulation on Distance Contracts (Official Gazette: 27.11.2014 / 29188)

SERVICE: Transactions other than the supply of goods performed in return for a fee or benefit

SELLER: The company that provides goods/services to the consumer as part of its commercial or professional activities

BUYER: The person or entity acquiring goods or services for non-commercial purposes

WEBSITE: The website owned by the SELLER

ORDER PLACER: The natural or legal person placing an order through the WEBSITE

PARTIES: The SELLER and the BUYER

CONTRACT: This agreement

GOODS: Movable property or digital content subject to purchase; within the scope of this contract, this includes Shayen Paris branded products.

3. Subject

The BUYER agrees and undertakes to order, purchase, and receive Shayen Paris branded products through the SELLER’s website in accordance with Law No. 6502 and the Regulation on Distance Contracts.

The prices published on the website are valid sales prices.

Prices announced for a specific period remain valid until the end of that period.

5. General Provisions

The BUYER acknowledges having read and confirmed the essential characteristics, price, and delivery information of the product.

Products will be delivered to the BUYER’s address within the specified period. If delivery cannot be made, the BUYER may terminate the contract.

The SELLER undertakes to deliver the product completely and in accordance with the order.

The SELLER may, with the BUYER’s approval, supply an equivalent product if necessary.

If delivery becomes impossible, the SELLER will notify the BUYER within 3 days and refund the payment within 14 days.

If payment is not made, the SELLER’s obligation to deliver ceases.

If the credit card is used fraudulently after product delivery, the BUYER must return the product within 3 days.

In case of force majeure, delivery may be postponed, or the cancellation/refund process will be completed within 14 days.

The BUYER agrees to the sharing of personal data and to receive communications from the SELLER.

It is the BUYER’s responsibility to inspect for damage upon delivery; if exercising the right of withdrawal, the product must not be used.

If membership information is inaccurate, the BUYER must compensate the SELLER for any resulting damages.

The use of the website must comply with the law; otherwise, liability rests with the BUYER.

Third-party links on the website are for informational purposes only, and the SELLER is not responsible for them.

6. Right of Withdrawal

The BUYER may exercise the right of withdrawal within 14 days from the date of product delivery by notifying the SELLER.

To return the product within the withdrawal period:

• It must be returned together with the invoice (issued by Royal Pharma),

• The return form must be completed,

• The product must be returned complete and undamaged, including its box and accessories.

Return costs are borne by the SELLER.

Campaign discounts used under the right of withdrawal may be revoked.

7. Products Not Eligible for Withdrawal

Personalized products, makeup, underwear, swimwear/bikinis, perishable or hygiene-sensitive products.

Opened cosmetic products cannot be returned.

For services, the right of withdrawal cannot be used once performance has begun with the consumer’s consent.

8. Default

In case of payment default, interest and liability towards the bank rest with the BUYER.

The SELLER may claim compensation from the BUYER for losses caused by the delay.

9. Jurisdiction

In case of disputes, applications may be made to the consumer arbitration committee or court located in the consumer’s place of residence or where the transaction was carried out.

Value limits:

• Below 2,000 TL → District consumer arbitration committee

• Below 3,000 TL → Provincial consumer arbitration committee

• In metropolitan cities, 2,000–3,000 TL → Provincial consumer arbitration committee

10. Enforcement

By placing an order and making a payment, the BUYER is deemed to have accepted all the terms of this contract.

The SELLER is obliged to confirm that the BUYER has read and approved the contract before the order is placed.
